Indemnity Claim Procedures

The indemnity claim shall be submitted by a client or shareholder of the member, or his agent, following fulfilling all the supporting data and documents, as well as the procedures taken by the complainant against the defendant company, within thirty days of the date the client or shareholder discovered the incident originating the indemnification.

Attachments to the indemnity claim

The documents required to be attached with the indemnification claim, whether the claim is filed against one of the member companies operating in the field of securities, or against one of the member companies whose securities or financial instruments are listed on the Egyptian Exchanges, as follows:

  • A Proof of identity of the complainant.
  • A proof of the complainant’s demand to the company complained against for his entitlements, together with notification of the Financial Regulatory Authority regarding the complaint.
  • Evidence of investigations conducted into the complaint by the Financial Regulatory Authority or by any judicial authority, if any, or evidence of the conclusion of such investigations.
  • Evidence of any judicial action taken by the complainant, if any.
  • A duly completed complaint form, filled in clearly, submitted to the Fund, and duly signed.
  • Filling out the attached complaint form legibly, submitting it to the Fund, and signing it

First: Documents required to be submitted by complainants along with the complaint against companies operating in the field of securities:

  • Copies of account opening contracts between the complainant and the respondent company.
  • Copies of cash deposit or withdrawal receipts.
  • Copy of the complainant’s cash account statement extracted from the accounting system of the respondent company.
  • Copies of purchase or sale orders.
  • Copies of purchase or sale invoices.
  • Statement of the complainant’s trading movements issued by Misr for Central Clearing, Depository and Registry (MCDR).
  • Client’s securities balance issued by the custodian or by Misr for Central Clearing, Depository and Registry.
  • Client account movement with a specific custodian.
  • Statement of valuation of the complainant’s securities portfolio extracted from the accounting system of the member engaged in portfolio formation and management activities (the respondent), at a specified date.
  • Any other documents supporting the grounds for indemnification.
  • Any other documents that the Committee deems necessary for the complainant to provide.

Second: Documents required to be submitted by complainants along with the complaint against companies whose securities or financial instruments are listed on the Egyptian Exchange:

  • Statement of the complainant’s balance of the securities subject of the complaint, issued by Misr for Central Clearing, Depository and Registry (MCDR) or by the custodian, as of the date of the compulsory delisting of the securities, in case of a complaint concerning compulsory delisting.
  • Statement of the complainant’s balance of subscription rights in the company’s capital increase, issued by Misr for Central Clearing, Depository and Registry (MCDR) or by the custodian with whom such rights are maintained, as of the last business day prior to the date of delisting such subscription rights before their due date, in case of a complaint concerning the delisting of subscription rights before maturity.
  • Document evidencing the bankruptcy of the Fund member, in case of a complaint concerning the member’s bankruptcy.
  • A certified true copy of the final judgment, in case of a complaint concerning final judgments rendered in favor of holders of freely traded securities or financial instruments in cases of fraud or gross negligence.
  • Any other documents that the Committee deems necessary for the complainant to provide.
